SOLVR PRIVACY POLICY

  1. INTRODUCTION

    A Squared Technologies Inc. o/a Solvr (“Solvr”, “we”, “us”) has created this Privacy Policy (“Privacy Policy”) in order to set out how we collect, use, and disclose personal information through our Solvr Site located at https://Solvrapp.com/ and our mobile Sites (the “Site), and the homework help services offered by third parties on Solvr (the “Services”) (as identified on our Site) to our users (“Users”).


    The privacy of our Users is of great importance to us. By visiting our Site or using our Services in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy and you hereby consent to the collection, use and disclosure of your Personal Information in accordance with this Privacy Policy.


  2. WHAT DOES THIS PRIVACY POLICY COVER?

    This Privacy Policy covers our collection, use and disclosure of information about identifiable individuals and information, which can be used to identify an individual (“Personal Information”). Personal Information may be collected about visitors to the Site, and our Users (“Customers”).


    This Privacy Policy does not apply to the practices of companies that we do not own or control, including those practices of third party companies.  


  3. COLLECTION AND USE OF PERSONAL INFORMATION

    3.1 Personally Identifiable Information.

    When you register for the Services or inquire about engaging Solvr, Solvr collects certain Personal Information from you (collectively, “Personal Information”). In particular, Solvr may collect your name, company name, email address, phone number, business address and/or billing information, such as billing address.We receive and store any information you enter on the Site, upload through our Site or from other third-party services that you link to your account (including, but not limited to Facebook, Instagram, Google, and Twitter) or provide to us in any other way, including by e-mail. When you send an e-mail, text or any other electronic communication to Solvr, we may retain your e-mail address or phone number or electronic id and the contents of the message you send.


    Registration: In order for you to use the Site and the services provided by Solvr, you may have to complete a registration form. As part of this registration form, we require select personally identifiable information (“ Personally Identifiable Information”) such as your name, e-mail address, password, professional or employment-related information, education information, photographs, and a security question.


    User Profile: To allow you to express yourself beyond just the information collected during registration, we enable you to provide additional information in your user profile. Information added to your user profile is accessible by other users of the Site. This information includes, but is not limited to, the user’s graduation year and other scholastic information.


    Billing Information: If you purchase goods or services through the Site, we may collect details of transactions you carry out through the Site.


    Other: We may collect and store Personally Identifiable Information you provide about yourself when you send us an electronic communication or contact us or Personally Identifiable Information you provide about yourself anywhere on the Site.


    Tutor: When you register to become a Solvr Tutor, we may collect information from you such as your education and employment history, phone number, photograph, country of residence, information to conduct a background check and the result of background information, and information we need to process payments to you, such as your bank account information, social security number, or taxpayer identification number, as necessary to facilitate payment and to comply with related legal obligations.


    Solvr uses the Personal Information to provide and deliver the Services you request or for you to deliver Services to Solvr users, to communicate with you about services, respond to your questions, provide updates on our services, and events, newsletters, and provide other news or information about us, for payments or billing, to make improvements to our Site, to resolve a dispute and for other purposes which we will notify you about and seek your consent.


    You can choose not to provide us with certain Personally Identifiable Information, but then you may not be able to take advantage of all of the services and products offered on the Site.


    3.2 Non-Personally Identifiable Information

    From time to time, we may also ask you to provide us with non-personally identifiable information, that is, data that is not intended to allow us to identify you personally, such as geolocation. This information may be aggregated and used for our internal purposes. No third party is intended to be able to know who you are as a result of the use of this information.


    We may also automatically collect Site usage information, such as the numbers and frequency of users accessing the Site, pages visited and similar data. This data is used in the aggregate, that is, as a statistical measure, and not in a manner that is intended to identify you personally. Aggregate information generally is collected through the use of cookies, pixel tags, analytics, and embedded scripts. This aggregate information helps Solvr determine general usage patterns and modify the Site in order to improve your experience. This type of aggregate information may be shared with third parties at any time.


    In addition to our use of technologies as described herein, we may permit certain third party companies to help us tailor advertising that we think may be of interest to you based on your use of the Site and/or services and to otherwise collect and use data about your use of Site. The information that such advertisers use to perform these functions will be non-personally identifiable Information. 


  4. HOW WE USE YOUR INFORMATION.

    We use your information for a variety of business purposes, including to:


    • Fulfil our contract with you and provide you with our Services, such as:
    • Managing your information and accounts;
    • Providing access to certain areas, functionalities, and features of our Services;
    • Communicating with you, or allow communication with your Tutors about your account, activities on our Services and policy changes;
    • Undertaking activities to verify or maintain the quality or safety of a service or device;
    • Processing your financial information and other payment methods for products or Services purchased;
    • Providing advertising, analytics and marketing services;
    • Processing transactions and applications; and
    • Allowing you to register for events.

    Analyze and improve our Services pursuant to our legitimate interest:


    • Detecting security incidents, protecting against malicious, deceptive, fraudulent or illegal activity, and prosecuting those responsible for that activity;
    • Measuring interest and engagement in our Services and short-term, transient use, such as contextual customization of ads;
    • Undertaking research for technological development and demonstration;
    • Researching and developing products, services, marketing or security procedures to improve their performance, resilience, reliability or efficiency;
    • Improving, upgrading or enhancing our Services or device;
    • Developing new products and Services;
    • Ensuring internal quality control;
    • Verifying your identity and preventing fraud;
    • Debugging to identify and repair errors that impair existing intended functionality;
    • Enforcing our terms and policies; and
    • Complying with our legal obligations, protecting your vital interest, or as may be required for the public good.

    Provide you with additional content and Services, such as:


    • Furnishing you with customized materials about offers, products, and Services that may be of interest, including new content or Services;
    • Auditing relating to interactions, transactions and other compliance activities; and
    • Other purposes you consent to, are notified of, or are disclosed when you provide personal information.
    • Automated profiling. We may use technologies considered automated decision making or profiling. We will not make automated decisions about you that would significantly affect you, unless such a decision is necessary as part of a contract we have with you, we have your consent, or we are permitted by law to use such technology.     • Use De-identified and Aggregated Information. We may use personal information and other data about you to create de-identified and aggregated information, such as de-identified demographic information, de-identified location information, information about the computer or device from which you access our Services, or other analyses we create.
    • Share Content with Friends or Colleagues. The Services may offer referral features whereby users may invite friends to use the Services. We will invite the referred individual through a one-time email and will not use this information for other purposes. The referred person may contact us at privacy@solvrapp.com to request that we remove this information from our active database. Additionally, we may enable you to "like" a product within our Services. If you choose to "like" or "share" content or to otherwise post information from or via the Services to a third-party web site, feature or application, that information may be publicly displayed, and the third-party web site may have access to information about you and your use of our Services.
    • Testimonials. We display personal testimonials of satisfied customers on our Services in addition to other endorsements. With your consent we may post your testimonial along with your name. If you wish to update or delete your testimonial, you can contact us at privacy@solvrapp.com.
    • Cross-Device Tracking. Your browsing activity may be tracked across different websites and different devices or apps. For example, we may attempt to match your browsing activity on your mobile device with your browsing activity on your laptop. To do this our technology partners may share data, such as your browsing patterns, geo-location and device identifiers, and will match the information of the browser and devices that appear to be used by the same person.
    • Notice Regarding Third-Party Websites. The Services may contain links to other websites, and other websites may reference or link to our website or other Services. These other websites are not controlled by us. We encourage our users to read the privacy policies of each website and application with which they interact. We do not endorse, screen or approve and are not responsible for the privacy practices or content of such other websites or applications. Visiting these other websites or applications is at your own risk.
    • Social Media and Other Publicly Accessible Forums. Our Services may include publicly accessible blogs, forums, social media pages, and private messaging features. By using such Services, you assume the risk that the personal information provided by you may be viewed and used by third parties for any number of purposes. In addition, social media buttons such as Facebook, Instagram, YouTube, Twitter, Pinterest, and LinkedIn (that might include widgets such as the "share this" button or other interactive mini-programs) may be on our site. These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the feature to function properly. These social media features are either hosted by a third party or hosted directly on our site. Your interactions with these features apart from your visit to our site are governed by the privacy policy of the company providing it.
    • APIs and SDKs. We may use third-party APIs and software development kits ("SDKs") as part of the functionality of our Services. APIs and SDKs may allow third parties including analytics and advertising partners to collect your personal information for various purposes including to provide analytics services and content that is more relevant to you.   5. STORAGE LOCATION AND TRANSFER OF PERSONAL INFORMATION

    Solvr processes and stores its data, including Personal Information, on servers located in Canada and the United States. Solvr also transfers data to third-party service providers. 


    By submitting Personal Information or otherwise using the Services, you agree to this transfer, storing or processing of your Personal Information in Canada and United States. You acknowledge and agree that your Personal Information may be accessible to law enforcement and governmental agencies in Canada and the United States under lawful access regimes or court order.


  6. DISCLOSURE OF PERSONAL INFORMATION WITH THIRD PARTIES

    Rest assured that we neither rent nor sell your Personally Identifiable Information to anyone and that we will share your Personally Identifiable Information only as described below.


    We may share non-Personal Information (such as aggregate user statistics, de-identified information, demographic information such as gender, age, graduation years, and other scholastic-related information), and Usage Information with third parties, including advertisers, content providers, and analytics providers; and third parties may collect non-Personal Information when you visit the Services.


    6.1 Delivery of Services.

    To facilitate communication between Solvr and you including, without limitation, responding to your questions or comments, sending electronic communications concerning our services, or to contact you for feedback. To administer your account, provide services to you and for Solvr marketing and promotional activities in accordance with any anti-spam legislation.


    6.2 Solvr Personnel or Service Providers.

    We may from time to time employ a person or a third party company to perform tasks on our behalf and we may need to share Personal Information with them to provide certain services. Unless we tell you differently, such persons or third parties do not have any right to use the Personal Information we share with them beyond what is necessary for them to provide the tasks and services on our behalf. 

    6.3 Business Transfers.

    If our business (or substantially all of our assets) are acquired by a third party, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information may be made available or otherwise transferred to the new controlling entity, where permitted under applicable law.

    6.4 With Your Consent.

    If we need to use or disclose any Personal Information in a way not identified in this Privacy Policy, we will notify you and/or obtain consent as required under applicable privacy laws. We may offer opportunities and features through the Services that are brought to you by a third party or that otherwise involve sharing your information with a third party. If you request, direct us or agree at that time to have your information shared, your information will be disclosed to that third party (or parties) and will be subject to the privacy policy and practices of that third party. This includes, without limitation, instances in which you use our Services to purchase services provided, in whole or part, by third parties. You also may request, sometimes through your use of an interactive feature or social media feature, that we share information about you with a third party or publicly.


    6.5 User Profile Information.

    Information collected during registration and subsequent visits, such as your full name and location, may be displayed to other Solvr users and the public through your User Profile. The User Profile is the place on Solvr where we allow you to tell other Site users about yourself. You may control certain personal information (like your name) that is displayed in your User Profile by visiting the Settings section of your User Profile.We display personal testimonials of satisfied customers on our Site in addition to other endorsements.


    6.5 Disclosures During Academic Investigations.

    We may disclose your information, including personal information upon request of an academic institution connected to an investigation into academic integrity.


    6.6 Sweepstakes, Contests and Promotions:

    We may offer sweepstakes, contests, and other promotions ("Promotion") that may require registration. By participating in a Promotion, you are agreeing to governing terms, conditions or official rules, which may contain specific requirements of you, including allowing the sponsor(s) of the Promotion to use your name, voice, likeness or other indicia of persona in advertising or marketing associated with the Promotion. If you choose to enter a Promotion, Personal Information, such as your name and shipping address, may be disclosed to third parties or the public in connection with the administration of such Promotion, including, without limitation, in connection with winner selection, prize fulfillment, and as required by law or permitted by the Promotion's official rules, such as on a winners list.


    6.7 Advertising Partners.

    Through our Services, we may allow third-party advertising partners to set technologies and other tracking tools to collect information regarding your activities and your device (e.g., your IP address, mobile identifiers, page(s) visited, location, time of day). We may also combine and share such information and other information (such as demographic information and past purchase history) with third-party advertising partners. These advertising partners may use this information (and similar information collected from other websites) for purposes of delivering targeted advertisements to you when you visit the third-party websites within their networks. This practice is commonly referred to as "interest-based advertising" or "online behavioral advertising. We may allow access to other data collected by the Services to share information that may be useful, relevant, valuable or otherwise of interest to you. If you prefer not to share your personal information with third-party advertising partners, you may contact us to discuss further.


    6.9 As Required by Law

    We may disclose your Personal Information to third parties without your consent if we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or property, our Users, or anyone else (including the rights or property of anyone else) that could be harmed by such activities. Further, we may disclose Personal Information when we believe in good faith that such disclosure is required by and in accordance with the law. We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary to:

    • satisfy any applicable law, regulation, legal process or governmental request; 
    • enforce our contracts or user agreement, including investigation of potential violations hereof; and
    • detect, prevent, or otherwise address fraud, security or technical issues. 

    The above may include exchanging information with other companies and organizations for fraud protection and spam/malware prevention. Notwithstanding the general terms of this policy, the collection, use, and disclosure of Personal Information may be made outside of the terms herein to the extent provided for in any applicable privacy or other legislation in effect from time to time, or pursuant to court orders.


  7. RETENTION

    We will keep your Personal Information for as long as it remains necessary for the identified purpose or as required by law, which may extend beyond the termination of our relationship with you. We may retain certain data as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally-identifiable data, account recovery, or if required by law. All retained Personal Information will remain subject to the terms of this Privacy Policy.


  8. CHILDREN

    13 YEARS OR OLDER - You must be 13 years or older to register to use the Solvr website. Solvr does not intentionally collect information about children under the age of 13. If we learn that we have collected information from a child under the age of 13, we will delete that information as quickly as possible. We require that anyone between the ages of 13 and 18 ask and receive his or her parent’s or guardian’s permission before using the Site or sending information about himself or herself or anyone else over the Internet. If you are under the age of 18, the Site requires you to confirm that you have spoken to your parent or guardian about using the Site and that your parent or guardian has given you permission to use the Site and to provide information about yourself to the Site. You also confirm that your parent or guardian has agreed to take responsibility for your use of the Site.


  9. RESIDENTS OF THE EUROPEAN ECONOMIC AREA (“EEA”)

    Solvr processes Personal Data where the processing is necessary for the performance of a contract with our Users, where the individual has provided consent and otherwise where the processing is necessary for the purposes of the legitimate interests pursued by us or our Users as data controllers.


    When we process Personal Data on behalf of our Users, we are acting as the data processor and our User is the data controller.


    If you are a resident of the European Economic Area (EEA), you have certain data protection rights. Solvr aims to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Information (known as “ Personal Data” under the EU General Data Protection Regulation). You have the right to complain to a Data Protection Authority about our collection and use of your Personal Data. For more information, please contact your local data protection authority in the European Economic Area (EEA). 


    If you wish to be informed what Personal Data we hold about you and if you want it to be removed from our systems, please contact us by emailing privacy@Solvrapp.com. Note that where we act as the data processor on behalf of our Users, you will be required to contact the data controller directly to exercise your rights.

  10. ACCESS, CORRECTION AND ACCURACY

    You have the right to access the Personal Information we hold about you in order to verify the Personal Information we have collected in respect of you and to have a general account of our uses of that information. Upon receipt of your written request, we will provide you with a copy of your Personal Information, although in certain limited circumstances, and as permitted under law, we may not be able to make all relevant information available to you, such as where that information also pertains to another User or individual. In such circumstances we will provide reasons for the denial to you upon request. We will endeavor to deal with all requests for access and modifications in a timely manner.


    We will make every reasonable effort to keep your Personal Information accurate and up to date, and we will provide you with mechanisms to update, correct, delete or add to your Personal Information as appropriate. As appropriate, this amended Personal Information will be transmitted to those parties to which we are permitted to disclose your information. Having accurate Personal Information about you enables us to give you the best possible service.


  11. CHANGES TO THIS PRIVACY POLICY

    We may amend this Privacy Policy from time to time. Use of Personal Information we collect is subject to the Privacy Policy in effect at the time such information is collected, used or disclosed. If we make material changes or changes in the way we use Personal Information, we will notify you by posting an announcement on our Site or sending you an email prior to the change becoming effective. You are bound by any changes to the Privacy Policy when you use the Site or Services after such changes have been first posted.


  12. EMAIL, TELEPHONE, AND MOBILE COMMUNICATION

    If you receive and unwanted email from us, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future emails. Note that you will continue to receive transaction-related emails regarding products or services you have requested. We may also send you certain non-promotional communications regarding us and our services, and you will not be able to opt out of those communications (e.g., communications regarding the services or updates to our Terms of Use or this Privacy Policy). We process requests to be placed on do-not-mail, do-not-phone and do-not-contact lists as required by applicable law. We will send you push notifications if you agree to receive them regarding updates on the Services and other items that may be relevant to you.


  13. Communications with Others on Our Site. 

    The Site includes a private messaging and video-calling features and allows community members to communicate and collaborate with each other. By using our Site you acknowledge the risks from disclosing your personal information to other users and accept to indemnify Solvr for any liability that may occur from choosing to share your personal information with other users of the Site. Our servers may record, and we may retain records of the content of any such user-to-user communications.


  14. CREDIT CARD INFORMATION AND METHODS OF PAYMENT

    Solvr does not collect, store or otherwise maintain any credit or debit card information from individuals. Solvr allows collection of certain billing information, as mentioned above under Personal Information, for tracking of payments. Purchases are processed through Stripe, Paypal, and Apple Pay, and the respective third-party’s terms of service and privacy policy governs the collection of this information.
